General Terms and Conditions

1. Definitions

LMD Logistics BV (“we”, “us”, “our”) refers to the supplier of shipping containers and related services.
Client (“you”, “your”) refers to any business or individual purchasing products or services.
Equipment refers to containers or other units hired or sold.
Contract refers to the legally binding agreement between you and LMD Logistics BV.
Force Majeure refers to unforeseen events beyond reasonable control, including but not limited to war, pandemics, strikes, or natural disasters.

2. Applicability

These Terms apply to all offers, contracts, and services provided by LMD Logistics BV. Deviations are valid only if agreed in writing.

For consumers, additional protections apply as outlined under EU Consumer Protection law.

3. Pricing and Payment

All prices are exclusive of VAT unless otherwise stated.
Payment terms are net 30 days unless otherwise agreed.
In case of late payment, statutory interest plus collection costs will be charged as permitted under Dutch law.
Ownership of goods remains with LMD Logistics BV until full payment is received.

4. Delivery and Risk

Delivery dates are indicative, not guaranteed.
Risk passes to the client upon delivery.
Clients must ensure accessibility and readiness of delivery sites.
Damage or loss occurring after delivery is the client’s responsibility.

5. Returns and Cancellations

For Consumers: A 14-day withdrawal period applies for online purchases under the EU Consumer Rights Directive, except for custom-built containers.
Return costs are borne by the client unless otherwise agreed.
For Businesses: Returns are subject to prior approval and may incur restocking fees.

6. Warranties

Equipment is sold or hired as-is, unless otherwise stated.
We warrant the equipment to be free from defects in material and workmanship at the time of delivery.

7. Liability

Liability is limited to the amount invoiced for the relevant transaction.
We are not liable for indirect or consequential damages, including loss of profits or business interruption.
Nothing in these Terms excludes liability for gross negligence or willful misconduct.

8. Force Majeure

LMD Logistics BV is not liable for delays or failures caused by events beyond our control, including but not limited to natural disasters, pandemics, government actions, strikes, or supply chain disruptions.

10. Governing Law and Dispute Resolution

Dutch law applies to all contracts.
Disputes shall be submitted exclusively to the competent court in Utrecht, Netherlands.
Where possible, disputes should first be resolved amicably.
